Five Ravens Fishing Hole — Participant Waiver and Release of Liability

By processing your payment you agree on behalf of all attending parties that you have read, understand and accept this waiver in full. You acknowledge and agree to the following:

I understand and accept these risks voluntarily and assume full responsibility for any personal injury, illness, death, or property damage that may occur as a result of my participation at the Facility, whether caused by negligence of the Facility, its owners, employees, volunteers, or agents, or otherwise, to the fullest extent permitted by law.

In consideration of being permitted to access and use Five Ravens Fishing Hole, I agree to the following terms:

  1. Release and Waiver

    • I, on behalf of myself, my heirs, executors, administrators, personal representatives and assigns, hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Five Ravens Fishing Hole, its owners, officers, directors, employees, volunteers, contractors, agents, affiliates, successors and assigns (collectively, the “Released Parties”) from any and all claims, demands, liabilities, causes of action, actions, damages or losses (including legal costs and expenses) arising out of or in any way connected with my participation in activities at the Facility, including claims arising from the negligence of the Released Parties, to the maximum extent permitted by law.

    • If I am registering on behalf of a minor, I certify that I am that minor’s parent or legal guardian and consent to their participation.

  2. Indemnity

    • I agree to indemnify, defend and hold harmless the Released Parties from and against any and all claims, demands, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or resulting from my negligent or wilful acts or omissions while at the Facility.

  3. Acknowledgement of Safety Rules and Obligations I agree to abide by all posted rules, staff instructions, and reasonable safety directions while on site, including but not limited to:

    • No swimming.

    • No running on docks, shorelines or wet surfaces.

    • Proper footwear is required; no bare feet.

    • Children under 12 must be supervised within arm's reach of a responsible adult at all times.

    • Life jackets/personal flotation devices (PFDs) must be worn when on dock for all children 12 and under or when instructed by staff.

    • No alcohol or recreational drugs onsite, before or, while participating in water activities or while operating any equipment provided by the Facility.

    • Report hazards, loose boards, unusual water conditions, injured wildlife, or other safety concerns to staff immediately.

    • Respect wildlife and vegetation; do not feed wildlife or leave food or garbage unattended.

    • Be aware of changing weather conditions; follow staff evacuation or shelter-in-place instructions immediately if given.

    • Use of personal flotation devices, or fishing gear on Facility waters is at my own risk and may be subject to additional rules and approvals.

  4. Health and Fitness

    • I confirm that I am physically able and sufficiently fit to participate in the activities for which I am registered. I will notify staff of any medical conditions, allergies, medications, or restrictions that may affect my ability to participate safely.

  5. Severability

    • If any provision of this Waiver is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

  6. Governing Law

    • This Waiver is governed by the laws of the Province of British Columbia, Canada. Any legal action shall be brought in the courts of that province.
